TERMS OF EMPLOYMENT

By booking a photo and video shoot date, the Client agrees to all the terms and conditions set forth below.

1. Format of Interaction and Agreement

1.1. All discussions regarding the details of the shoot (technical specifications, requirements for the contractor, requests, references, etc.) must be conducted in writing (via correspondence).

1.2. If details are discussed by phone or in person, all agreed-upon information must be confirmed in writing. 

1.3. Agreements recorded in writing take precedence.

2. Copyright and Use of Materials

2.1. The copyright to all photo and video materials created belongs to the Contractor. 

2.2. The Client consents to the use of images featuring them in the Contractor’s portfolio, social media, contests, exhibitions, publications, training materials, and for other promotional purposes.

2.3. If the Client objects to the publication of the materials, they must notify the Contractor in writing prior to the shoot. No additional payment is required for refusing publication.

2.4. The transfer of RAW files does not imply a transfer of copyright. 

2.5. Source files, processed files, and other materials shall not be disclosed to third parties without the Client’s consent.

3. Booking, Rescheduling, and Canceling a Photo Shoot

3.1. Upon booking a date, the Client receives: 

  • a reservation for the date and time; 
  • a checklist for preparation; 
  • consultation on the concept, location, and style; 
  • recommendations and other related materials.

3.2. In the event of a cancellation, the prepayment (date reservation) is non-refundable. 

3.3. A rescheduling of the shoot is possible no later than 3 days before the scheduled date and is permitted no more than once, to the next available date with the Contractor.

3.4. In the event of cancellation of the shoot, refunds for studio rental fees are governed by the specific studio’s policies and must be discussed with its administration.

3.5. In the event of force majeure (illness, weather conditions, technical malfunctions, restrictions, etc.), the parties shall agree to reschedule the shoot for the earliest possible date. 

3.6. The Contractor reserves the right to cancel the shoot in the event of a material breach of the terms of this agreement.

4. Payment

4.1. The remaining balance is due immediately upon completion of the shoot, taking into account any advance payment already made. 

4.2. The order fulfillment period begins upon full payment for the service.

5. Deadlines for submitting materials

5.1. The delivery time for photos is 7 to 14 calendar days.

5.2. The delivery time for video footage is 7 to 21 calendar days.

5.3. If the Client delays selecting the photos by more than 7 days, the delivery deadline will be automatically extended. 

5.4. The source materials will be stored by the Contractor for 1 month after the final product is delivered. Storage is not guaranteed after this period.

6. Formats and source materials

6.1. If the Client requires source material in JPG format, this must be specified prior to the photo shoot. 

6.2. RAW files are provided for an additional fee of 50% of the photo shoot cost.

7. Revisions and alignment with the result

7.1. The price includes up to two rounds of revisions within the scope of the agreed-upon terms of reference. 

7.2. Additional revisions are billed separately. 

7.3. Revisions are performed exclusively within the scope of the pre-agreed scope of work. Changes to the concept, format, pace, structure, or duration after filming are considered a new assignment and are discussed separately.

7.4. By selecting the Contractor, the Client confirms their agreement with the shooting and editing style. 

7.5. Subjective assessments of the result («I don’t like it, ” «I expected something different, ” «it’s not my style») do not constitute grounds for a refund.

8. Liability of the Parties

8.1. The service is considered rendered after the photo shoot has been completed and the finished and/or raw materials have been delivered.

8.2. A refund is possible only if the service was not rendered due to the Contractor’s fault.

8.3. No partial or full refunds are provided after the photo shoot has been completed.

8.4. The Contractor shall not be liable for: 

the Client’s appearance; 

the work of any makeup artists, stylists, or other specialists engaged by the Client; 

or the condition of clothing and props, unless provided by the Contractor. 

8.5. In the event that the Client is late, the shooting time will not be extended. 

8.6. In the absence of specific and quantifiable comments on the material (e.g., non-compliance with the technical specifications), the service is considered to have been performed properly.

9. ADDITIONAL TERMS AND CONDITIONS FOR COMMERCIAL (BUSINESS) PHOTOGRAPHY

9.1. Upon full payment, the Client is granted a non-exclusive license to use the materials for commercial and advertising purposes without any territorial or time restrictions, unless otherwise agreed upon separately. 

9.2. The transfer of materials to third parties (contractors, marketing agencies, partners) is permitted within the scope of the Customer’s business activities.

9.3. The full transfer of exclusive copyright shall be formalized in a separate written agreement. 

9.4. The Client warrants that it holds the rights to use the logos, products, music, and other intellectual property provided for the shoot.

9.5. The Client is solely responsible for obtaining filming permits for the selected locations, if required.

9.6. The Contractor shall not be liable for any legal consequences arising from the Client’s use of the materials.

10. RETURN POLICY

10.1 The service is considered rendered after the photo shoot has been completed and the materials have been delivered. 

10.2 A refund is possible only if the service was not provided due to the Contractor’s fault. 

10.3 Subjective assessments of the result do not constitute grounds for a refund. 

10.4 Partial or full refunds after the photo shoot has been conducted are not provided.
